Please read these Terms of Service ("Terms") carefully before using Computer Activity Monitor ("CAM", "we", "us", or "our") and its associated software agents. By creating an account or downloading our software, you agree to be bound by these Terms.
⚠️ Important Notice for Employers: You are solely responsible for ensuring that your use of this software complies with all applicable federal, state, and local laws regarding employee monitoring and privacy. This includes, but is not limited to, notifying employees that their computer activity is being monitored. We strongly recommend consulting with legal counsel before deploying monitoring software.
1. Acceptance of Terms
By accessing or using Computer Activity Monitor, you confirm that you are at least 18 years of age, have the legal authority to enter into these Terms on behalf of yourself or your organization, and agree to comply with all applicable laws and regulations.
2. Description of Service
Computer Activity Monitor provides software tools that allow businesses to monitor computer activity on devices owned or managed by the business. The service includes:
- A monitoring agent installed on employee computers
- A web-based dashboard for viewing activity reports
- Data storage and reporting features
- An optional self-hosted deployment option
3. Employer Responsibilities and Legal Compliance
You, as the account holder and employer, are solely responsible for:
- Employee notification: Informing all employees and users whose computers will be monitored, prior to installing the monitoring agent. Many jurisdictions require written consent or conspicuous notice before monitoring employee computer activity.
- Legal compliance: Ensuring your use of this software complies with all applicable laws in your jurisdiction, including but not limited to the Electronic Communications Privacy Act (ECPA), applicable state wiretapping and privacy laws, and any relevant labor laws.
- Device ownership: Only deploying the monitoring agent on devices that are owned by your organization or on personally-owned devices where employees have provided informed consent.
- Data handling: Handling all collected data in compliance with applicable privacy laws, including proper storage, access controls, and data retention policies.
We are not responsible for any legal liability arising from your failure to comply with applicable laws regarding employee monitoring. By using our service, you indemnify us against any claims arising from your non-compliant use.
4. Prohibited Uses
You may not use Computer Activity Monitor to:
- Monitor individuals without their knowledge on devices you do not own or control
- Monitor minors under the age of 18 without appropriate parental or legal authority
- Engage in stalking, harassment, or any illegal surveillance
- Collect data in violation of applicable privacy laws
- Resell or redistribute our software without written permission
- Attempt to reverse engineer, decompile, or modify our software
- Use the service for any unlawful purpose
5. Subscription, Trial, and Payment
We offer a 60-day free trial for hosted accounts. After the trial period:
- Your account will require a paid subscription to continue using the hosted dashboard and reports. Data collection from your installed agents continues during any payment-processing period so no activity history is lost.
- Payment is by invoice. You may choose annual invoicing (payable by check or PayPal; extended payment terms available) or monthly billing via PayPal automatic payments.
- Fees are charged per monitored computer, based on the number of distinct computers reporting activity in the billing period.
- Self-hosted use of the agent API and database is free with no time limit. The self-hosted reporting suite and email support are available under an optional support plan, billed per monitored computer as reported by your server's monthly license check-in.
- All fees are non-refundable unless otherwise required by law
- We reserve the right to change pricing with 30 days notice
6. Data Collection and Privacy
Our monitoring agent collects the following data from monitored computers:
- Mouse movement and click counts
- Keyboard press counts (not keystrokes or content)
- Active application name
- Active and idle time periods
- Computer name and username
We do not collect passwords, keystrokes, screenshots, or personal communications. For full details on how we handle data, please see our Privacy Policy.
7. Data Retention
For hosted accounts, activity data is retained as follows:
- Detailed (per-report-interval) activity data is retained for 90 days
- Daily summary data is retained for 1 year, after which it is permanently deleted
- Upon account cancellation, your data will be retained for 30 days to allow for export, then permanently deleted
- Self-hosted customers are responsible for their own data retention policies
8. Service Availability
We strive for high availability but do not guarantee uninterrupted service. We are not liable for any losses resulting from service outages, data loss, or interruptions. The monitoring agent includes offline buffering to minimize data loss during outages.
9. Account Security
You are responsible for maintaining the security of your account credentials and API keys. You must notify us immediately of any unauthorized access. We are not liable for losses resulting from unauthorized account access due to your failure to maintain security.
10. Termination
We reserve the right to suspend or terminate your account at any time if we determine you are in violation of these Terms, using the service for illegal purposes, or abusing the service in any way. You may cancel your account at any time from the account settings page.
11. Disclaimer of Warranties
The service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the service will be error-free, uninterrupted, or meet your specific requirements.
12. Limitation of Liability
To the maximum extent permitted by law, Computer Activity Monitor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising from your use of or inability to use the service.
13. Indemnification
You agree to indemnify, defend, and hold harmless Computer Activity Monitor and its operators from any claims, damages, losses, or expenses (including legal fees) arising from your use of the service, your violation of these Terms, or your violation of any applicable law or regulation.
14. Changes to Terms
We may update these Terms from time to time. We will notify you of significant changes by email or by posting a notice on the dashboard. Continued use of the service after changes constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Oklahoma.
